Creator agreement
A seat on the ridge is a contract. Coverage is not. Affiliate is a code. Barter is a plate you must name as an ad. Philippine Consumer Act and the FTC Endorsement Guides (16 CFR 255) both sit on the post — TikTok and Instagram travel.

Article 1 — Parties
House: Kabesera Café / Kabesera Bed & Coffee, Eastridge Village, Angono / Binangonan, Rizal. Desk: booking@kabesera.com · 0966 762 5352.
You: an independent creator. Not an employee, not a talent-agency talent, not a Shopee seller. You file your own BIR. We issue no 2316 for a hosted sit.
Article 2 — Definitions
Material connection (FTC): anything of value — a fee, a free pour, a plate, a sunset hold, a commission, a family or employment tie.
Clear and conspicuous (FTC 2023): difficult to miss, easily understood by an ordinary guest, in the same language as the post, with the endorsement itself — not behind More, not only in bio.
Affiliate code: ?ref=yourhandle plus the UTM set in the schedule. Last-click 30 days on the till. First-touch 90 days in UTM.
Barter / hosted sit: one named pour + one plate, or two sunset seats. Not a wage.
Coverage: you posted, we did not host, no code. We may share once. No money moves.
Article 3 — The five lanes
Affiliate — a unique code. Guest pays on kabeseracafe.com. Cut on the 10th. No code in caption and bio: no cut.
House promotion — festival shirt 10%, holiday doors, sunset Thursday. That peso is for the guest. You are paid only if the same post carries your code.
Hosted sit (barter) — the kit. You must use the barter #ad line. Superimpose it. Say it on LIVE.
Paid collab — a written fee from the desk. Exclusive only if we paid for exclusive. Still #ad.
Coverage — no host, no code. Honest. We do not call it a partnership.
Article 4 — Disclose (R.A. 7394 and FTC 16 CFR 255)
Both of us can be liable if the connection is hidden. You do not wait for us to write the caption.
Words that work: advertisement, ad, sponsored, “thanks Kabesera for the free meal”, “I earn a commission if you book with my link.”
Words that fail: #collab, #sp, #spon, #partner, “thanks” alone, “ambassador.” Do not bury #ad in a hashtag pile.
Video: on screen in the first seconds AND in the spoken line. Description-only is not enough. Some people watch without sound.
LIVE: start + every 15 minutes + on-screen the whole time. Viewers who join late must still see it.
Picture / story: superimpose, leave it long enough to read.
US viewers can see a TikTok from Angono. FTC still applies when that is reasonably foreseeable. We write for both.

Required affiliate line, next to the URL: “I may earn a commission if you order with my link. This is an ad.”
Article 5 — Affiliate and UTM
Build the link with ref, utm_source (the app), utm_medium=affiliate, utm_campaign=locally-yours, utm_content=handle, utm_term=the SKU. The house builder on /collab writes this.
Cuts: sunset cover ₱150 seated · stay 8% first night · cake 10% · jars and merch 12% · skip tray 8% · Ridge Village tour 12% · company covered room ₱2,000 when booked.
Payout GCash on the 10th for the month closed. Below ₱500 rolls forward. Cancelled, refunded, staff, and self-orders do not pay. Fraud voids the code.
We count clicks and paid tickets. We hash the visitor. We do not scrape DMs. We do not buy views.
Article 6 — Content, reviews, children
Your words. Our facts. Name the dish as the menu names it. Do not invent a cloudless sky, a 50% off, or a medical claim the kitchen cannot prove.
You may not sell a star for a plate. FTC Rule on Consumer Reviews (16 CFR 465). Google is yours. Help is for complaints.
You may not review a plate you did not taste. If it was terrible, you may not call it terrific because we hosted you.
Children stay off the brief unless a parent is the creator and consents in writing.
We may share once on house channels. You keep the copyright. You license us a non-exclusive right to that one share and to the tracker screenshot.
Article 7 — Term, morals, law
Either side ends the seat in writing. Codes stop at midnight Manila that day. Earned unpaid cuts still pay on the next 10th.
We may refuse a full month, a live that hides the sit, a fake review, or a handle that will not say #ad.
You keep the post honest if we take the kit back. Take-down only for a legal or safety wound, not for a star we did not like.

Like, tag, pin
A tag can be an endorsement. If the sit was hosted or you earn a cut, the same #ad sits on that tag.
